By accessing and using The Catalyst test preparation platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

These Terms of Service apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. Your use of the Service constitutes your agreement to these terms.

2. Use License

Permission is granted to temporarily access the materials on The Catalyst's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained on The Catalyst's website
• Remove any copyright or other proprietary notations from the materials

This license shall automatically terminate if you violate any of these restrictions and may be terminated by The Catalyst at any time. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Payment Terms

Certain aspects of the Service may be provided for a fee. You agree to pay all fees associated with your use of the Service. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

We reserve the right to change our pricing at any time. We will provide notice of any price changes at least 30 days in advance. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the new price.

5. Guarantee and Refund Policy

The Catalyst offers a score improvement guarantee for users who commit a minimum of 16 hours of practice. If you meet the practice requirements and do not see score improvement, you may be eligible for a refund. Specific terms and conditions of the guarantee are detailed in our refund policy.

To be eligible for a refund under our guarantee, you must provide evidence of completing the required practice hours and demonstrate that you did not achieve score improvement. Refund requests must be submitted within 30 days of your exam date.

6. Disclaimer

The materials on The Catalyst's website are provided on an 'as is' basis. The Catalyst makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, The Catalyst does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

7. Limitations

In no event shall The Catalyst or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on The Catalyst's website, even if The Catalyst or a The Catalyst authorized representative has been notified orally or in writing of the possibility of such damage.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
